The cases presented will touch on a variety of topics in real property law and practice, including: the statutory definition of "public waters," the scope of exculpatory clauses in contracts, the effect of conditions in a will on a devise of land, the scope of replacement-cost insurance required by state statute, and more!

Purchasing and Selling Real Property

This course will focus on the legal principles, doctrines, causes of action and rights and remedies impacting purchase agreements and option contracts. Particular attention will be given to the manner in which basic contract law applies to real estate, including enforceability of the contract, statute of frauds, as well as an analysis of common purchase agreement provisions. We will also review relevant statutes such as implied warranties, contract cancellation and mandatory disclosures.
