This discussion among four practitioners who represent both plaintiffs and defendants in antitrust litigation involves recent court decisions under Federal Rule of Civil Procedure 23. The focus will be on class certification decisions in antitrust cases, including the relevant facts and legal analysis in those decisions. Panelists will also discuss the effect non-antitrust class certification decisions may have on antitrust litigation in the future. Subject matter will include, for example, cases involving horizontal price-fixing claims under section 1 of the Sherman Antitrust Act and pay-for-delay claims regarding the entry of generic pharmaceuticals into the market.
