Cases
on online contract formation continue to present new and
interesting fact twists—page layouts, font types and sizes, language variations,
etc. Most courts have abandoned the clickwrap and browsewrap categories,
which don’t describe a useful legal construct or dictate a particular
result. Recently, though, some courts have crafted a new category—the “sign-in wrap,” which
other courts have criticized. The panelists cover all of that and more, with
the help of screenshots included in courts’
opinions.
