Two former DOJ trial attorneys and a prominent healthcare
economist will discuss the evolution of vertical merger enforcement, with a
special emphasis on mergers in the healthcare industry. Peter Schwingler
and Anna Sallstrom served on the DOJ's trial team in AT&T/Time Warner before
joining the Minneapolis offices of Stinson and Faegre, respectively. Dr.
Dov Rothman, a managing principal at Analysis Group, has significant experience
in healthcare mergers and regularly advises on vertical issues. Their CLE
will address the core theories of liability in vertical merger cases – including
raising rivals' costs and vertical foreclosure – as well as the procompetitive
benefits of vertical transactions. The panel will cover the AT&T/Time
Warner trial, the DOJ and FTC's joint vertical merger guidelines, and the unique
challenges of vertical merger enforcement in the healthcare space.
