Celebration of Law Day | The Legacy of Roe v. Wade
The Supreme
Court’s 1973 decision in Roe v. Wade holding that a woman’s right to
choose to have an abortion is a fundamental constitutional right has been
continuously questioned. Subsequent decisions have weakened Roe, including the
Court’s 1992 in Planned Parenthood of Southeastern Pennsylvania v.
Casey, although the Court did reaffirm Roe’s central holding that a woman
has a fundamental right to choose to have an abortion prior to viability. This
term, the Court heard arguments in Dobbs v. Jackson Women's Health
Organization, which directly presents with the issue of whether Roe should
be overruled. This program will explore the implications the forthcoming
decision in the case.
