In March 2020, the Minnesota Supreme Court held in State v. Mrozinski that the state has the power to criminalize threatening statements, even if made without specific intent to terrorize.  Mrozinski is only the latest in a progeny of cases that have wrestled with the line between when speech is free—and when it isn’t.  Driven at times by attempts to regulate harms associated with new technologies, and arising in a time of heightened passions in our country, these cases raise significant questions about how we balance individual liberties and government power. 

Join our distinguished to discuss what these cases say, what it means for Minnesota, and how they think these issues may (or should) be resolved going forward.
