Resolution Section (ADR) and Consumer
Law Section. The ADR Section holds a business meeting at
12 Noon prior to the CLE program that begins by 12:15 pm. Lunch is brown bag, however, light
refreshments of fruit and pastries will be provided.
CLE Program:
With pervasive clickwrap agreements, each of us has
become, willingly or not, a party to scores of arbitration agreements. With the
Supreme Court's expansive reading of the Federal Arbitration Act and resistance
to class actions, federal courts are not likely to be open to consumer disputes.
The individual consumer, then, has no venue but arbitration under the agreement.
Where the arbitration provision has been written by one party, where negotiation
is impossible, and where there are likely imbalances in knowledge and expertise,
can an individual consumer get a fair shake?
