Strategic Counseling for Student Loan Defaults

This program is being co-presented by the HCBA Debtor/Creditor Section and the New Lawyers Sections of the MSBA and HCBA.

This continuing legal education program will be an interactive experience with speakers from both sides of the student loan aisle, borrower's counsel and lender's counsel, with audience participation in the form of questions and comments highly encouraged. The program will begin by discussing the situation where a borrower runs into financial trouble and is contemplating defaulting on loans, focusing in on payment delinquency, alternative repayment options, and other work-out arrangements. The program will then explore the consequences of a borrower default and post-default options for both lenders and borrowers, such as rehabilitation and bankruptcy. The program is designed to be interactive to ensure that attendees get as much out of the program as possible.

Lunch is included in your registration. Registration and lunch will begin at 12:15 pm, the CLE program will run from 12:30 pm to 1:30 pm.

Panelists:

Randall Ryder | Ryder Law
My practice is a specialized version of consumer law. I only handle two types of cases: I represent consumers that have been harassed by debt collectors and I defend consumers in debt collection lawsuits. Many of these cases involve student loan debt, which is a large part of my practice. I only represent consumers because I love fighting for the little guy. Prior to law school, I lived in Los Angeles for four years, writing screenplays and working on commercials and music videos. Notably, I had the chance to work on Arnold Schwarzenegger’s first campaign commercials (I’m actually taller than him). I was also retained by a Beverly Hills law firm as an expert on Marvel Comics.

David Friedman | Friedman Murray Law Firm
David has handled more than 150 bankruptcy cases since starting the firm. He enjoys more complex cases, including lots of Chapter 13 reorganization. His cases often involve restructuring mortgages to save people’s homes. While many bankruptcy lawyers see bankruptcy as the only thing they do, David is always looking for claims under consumer protection laws to help put more money in his clients’ pockets. David is licensed to practice law in Minnesota and New York.

Andrew D. Wold | Senior Staff Attorney | Office of Higher Education
Andrew Wold is a senior staff attorney at the Minnesota Office of Higher Education. His primary practice is in the SELF Loan division, working with student loan borrowers to resolve their defaulted loans.

Kari Barber | Corporate Counsel | Educational Credit Management Corporation
Kari is no stranger to student loans. She first began representing student loan creditors while in private practice where she focused on creditors’ rights and remedies. She later joined the in-house legal team at Educational Credit Management Corporation, a federal student loan guarantor in the Federal Family Education Loan Program. At ECMC she primarily manages a team of outside litigation counsel across the country concerning student loan bankruptcy and collection matters. Kari also provides legal services to business partners on a variety of federal student loan regulatory issues. She has been a keynote speaker at conferences for the National Council of Higher Education Loan Resources and National Organization of Social Security Claimants’ Representatives on topics such as litigation tactics and hot topics in bankruptcy related to student loans. Kari’s organization is passionate about student success and assisting student loan borrowers in managing their federal student loan obligations, and she is determined to advance this mission in her work at ECMC.
