Lawyers are entrusted with
some of the most difficult and consequential
issues facing their clients. When clients have difficult decisions to make,
they rely on their attorneys to understand what the likely outcomes are. In
the business world, important decisions are now almost always made by
analyzing data. Analytics are used for important decisions on everything from sales
and marketing to supply chain management and
HR. For the most part, though, lawyers still tend to
advise their clients based not on data, but on their own anecdotal
experience. With clients continuing to adapt to a data-driven world, do lawyers face
a professional obligation to use data analytics to inform their legal advice?
